TDHCA Posts Blacklined 2024 QAP

The Texas Department of Housing and Community Affairs (TDHCA) has posted to its website a blacklined version of the 2024 Qualified Allocation Plan (QAP) that is proposed to be adopted at the meeting of the Governing Board to be held on November 9, 2023. This version reflects revisions that have been made since the proposed draft QAP posted in the Texas Register for public comment after the September meeting.

Public Facility Corporation Compliance Monitoring rule public comments due by December 11, 2023

The Texas Department of Housing and Community Affairs (TDHCA) is releasing a proposed rule action for public comment, as approved by the TDHCA Governing Board at its meeting held on October 26, 2023.

The proposed new rule is responsive to the passage of HB 2071 (88th Regular Legislature), which requires TDHCA compliance monitoring oversight of Public Facility Corporation (PFC) multifamily residential developments that are initiated on or after June 18, 2023. HB 2071 requires TDHCA to adopt rules necessary to implement Section 303.421 and Section 303.0425 of Chapter 303, Local Government Code. Therefore, the new rule is being made available for public comment.

Public Comment Period Open for Draft 2023 State of Texas Consolidated Plan Annual Performance Report

The Texas Department of Housing and Community Affairs (TDHCA) announces the opening of a 15-day public comment period for the State of Texas Draft 2023 Consolidated Plan Annual Performance Report – Reporting on Program Year 2022 (the Report) as required by the U.S. Department of Housing and Urban Development (HUD). The Report is required, as part of the overall requirements, governing the State’s consolidated planning process. The Report is submitted in compliance with 24 CFR Section 91.520, Consolidated Plan Submissions for Community Planning and Development Programs. The 15-day public comment period begins Wednesday, November 1, 2023, and continues until 5 p.m., Central Time, on Wednesday, November 15, 2023.

TDHCA Asset Management Reminder: LURA Origination

TDHCA’s Asset Management Division reminds Owners and Management Agents with properties intending to place buildings in service in 2023 that the recorded Housing Tax Credit (HTC) LURA must be returned to the Department no later than the end of the first year of the Credit Period: December 31, 2023.

TDHCA releases Rule for public comment on 10 TAC Chapter 1, Subchapter C

Section 2306.1112 Tex. Gov’t Code required the Department to establish the Executive Award Review and Advisory Committee (EARAC), which provided approval of all awards prior to presentation to the Board. However, HB 4550, passed by the 88th Texas Legislature, removed Section 2306.1112 from the Department’s statutes, thereby eliminating EARAC. Sections 2306.057 and 2306.6713 still require the Compliance Division to assess the compliance history of applicants, the compliance issues associated with the proposed or existing Development, and provide such assessment to the Board. 2 CFR Section 200.331(b) and (c), and Texas Grant Management Standards (TxGMS), also require that the potential performance and background of applicants are reviewed with state and federal funds.
