The Texas Department of Housing and Community Affairs (TDHCA) is releasing a proposed rule action for public comment, as approved by the TDHCA Governing Board at its meeting held on October 26, 2023.
The proposed new rule is responsive to the passage of HB 2071 (88th Regular Legislature), which requires TDHCA compliance monitoring oversight of Public Facility Corporation (PFC) multifamily residential developments that are initiated on or after June 18, 2023. HB 2071 requires TDHCA to adopt rules necessary to implement Section 303.421 and Section 303.0425 of Chapter 303, Local Government Code. Therefore, the new rule is being made available for public comment.

The Report is required, as part of the overall requirements, governing the State's consolidated planning process. The Report is submitted in compliance with 24 CFR Section 91.520, Consolidated Plan Submissions for Community Planning and Development Programs. The 15-day public comment period begins Wednesday, November 1, 2023, and continues until 5 p.m., Central Time, on Wednesday, November 15, 2023.
