The Texas Department of Housing and Community Affairs (TDHCA) monitors on behalf of the State of Texas for compliance with the Section 811 Project Rental Assistance Program (811 PRA). TDHCA is reminding Multifamily Owners participating in the 811 PRA program that they must comply with the documentation and notice requirements under 10 TAC Section 8.6(g)(3)(A), Section 8.6(j)(3), Section 8.6(l)(2), Section 8.6(l)(8) and the current HUD Handbook 4350.3. The Department requires that documentation be provided at specific times, such as during monitoring reviews and upon request.

Multifamily Owners and their designated agents are required to document in writing all communications between prospective and assisted 811 PRA tenant families regarding applications, notifications, evictions, complaints, non-renewals and move-outs. When an application for a prospective 811 PRA tenant family is denied, the Department will review that denial notice to ensure it contains: the reason for said denial, notification that the denied applicant has rights to appeal, and complies with other requirements under the program. Three days prior to notifying in writing an assisted 811 PRA tenant family, Owners must submit to TDHCA for review the following notices: termination of assistance, non-renewal of lease contract, and termination of tenancy. The Department will review these notices for compliance under program guidelines and may choose to mitigate directly or through partnerships with Texas Health and Human Services partners any issues resulting in these notices.
