The Texas Department of Housing and Community Affairs (TDHCA) Asset Management division would like to remind all Owners and Agents of Housing Tax Credit (HTC) developments that the Land Use Restriction Agreement (LURA) for developments with a 2024 start date must be recorded by December 31, 2024. To ensure there are no delays in the recording process, requests should be submitted by the end of September.
Key Details:
1. LURA Origination Requests:
- Submission Deadline: September 30, 2024
- Purpose: Since LURA origination may take 30 days or more, requests must be submitted by the end of September to avoid any potential delays due to corrections or recording timelines.
- New Form: Use the updated LURA Origination Request package, which can be found in the LURA Origination section of the TDHCA website at this link.
2. Additional Information:
- 4% HTC Awards: If your development has received a 4% HTC award and has a Bond LURA, you must still request a separate Housing Tax Credit LURA.
- MFDL Fund Awards: Similarly, if your development received MFDL funds along with Housing Tax Credits, you are still required to request a Housing Tax Credit LURA.
