The Texas Department of Housing and Community Affairs (TDHCA) has proposed rule replacements relating to 10 TAC Section 2.302, Administrative Penalty Process, and 10 TAC Section 2.401, General, as approved by the TDHCA Governing Board on May 7, 2026. The rules will be open for public comment from May 22, 2026, through June 22, 2026.
The rules, including preambles, are expected to be published in the Texas Register edition of May 22, 2026, and those published versions will constitute the official version for purposes of public comment and can be found at https://www.sos.texas.gov/texreg/index.shtml.

The proposed replacement rules for 10 TAC Section 2.302, Administrative Penalty Process, and 10 TAC Section 2.401, General, incorporate the new HOME Final Rule and associated recent TDHCA rule amendments for compliance monitoring and written procedures, and incorporate new PRWORA and HUD requirements including Verification of Occupant Legal Status. The proposed replacement rules also include minor rule clarifications.
