The Texas Department of Housing and Community Affairs (TDHCA) has published the Housing Finance Corporation (HFC) Annual Service Fee Submission Instructions and the HFC Annual Service Fee Form on its website at https://www.tdhca.texas.gov/housing-finance-corporation-compliance-monitoring.
Under Title 10 of the Texas Administrative Code (TAC) Part 1 Chapter 10 Subchapter J Section 10.1203(4) HFC Users with multifamily HFC Developments subject to an annual Audit Report are required to submit an annual service fee to the Department for each applicable HFC development.
Under the regulations, the HFC Annual Service Fee:
- Is required for each HFC Development subject to Chapter 394 and TAC Section 10.1201?Section 10.1207
- Must be calculated in the manner provided in TAC Section 10.1203(4)
- Must be paid by check or money order
- Must include sufficient identifying information (property name and address)
- Must be received by the Department no later than June 1 for the current audit year along with the HFC Payment Annual Service Fee Form
