The Texas Department of Housing and Community Affairs (TDHCA) has posted to its website the final 2022 Qualified Allocation Plan (QAP) as approved with modifications by the Governor on December 1, 2021. Two modifications were made by the Governor. The first change reduces the points possible in Section 11.9(e)(7) for Single Family Right of First Refusal from 2 points to 1 point. The second change found at Section 11.302(a) ensures that over-sourcing of funds for non-market units does not occur when combining tax credits with soft funds from other units of government.

Two documents are posted: a clean version of the QAP as modified, and a version that tracks changes from the Governor-approved 2022 QAP in comparison to the 2021 QAP.

These posted versions of the QAP are provided as a courtesy and can be found under Multifamily Program Rules at this link: https://www.tdhca.state.tx.us/multifamily/nofas-rules.htm. The official version of the 2022 QAP, as a state promulgated rule, will be published in the Texas Register and subsequently posted on the website of the Texas Administrative Code. Non-substantive changes may be made between these posted versions and the official version published in the Texas Register.
