The Texas Department of Housing and Community Affairs (TDHCA) has posted a draft of the HOME Match Contract and HOME Match Land Use Restriction Agreement (LURA). Pursuant to 10 TAC Section 11.204(15) of the 2024 Qualified Allocation Plan (QAP), all developments with HOME Match Eligible Units will be required to enter into a Contract and LURA with the Department. The Contract and LURA can be found at https://www.tdhca.texas.gov/multifamily-direct-loan-program.
This provision is applicable to Tax-Exempt Bond Developments through a local issuer where the Participating Jurisdiction is not claiming the bond proceeds as Match, as well as Tax-Exempt Bond Developments where the Department is the bond issuer.
While this does not constitute a formal period of public comment, as this is not a rule that would fall under the Administrative Procedures Act, the draft Contract and LURA are provided as a courtesy. This is an opportunity for those affected by this new requirement to review the documents and provide substantive input or concerns.
To expedite TDHCA review, any such input must be expressed in list form beginning with the applicable section, line, and page. Stylistic comments, or a “track changes” version of the contract, will not be considered by the Department. No formal response will be made to this stakeholder input.
