On December 18, 2025, the Texas Department of Housing and Community Affairs (TDHCA) provided technical assistance regarding the implementation of the Housing Opportunity Through Modernization Act of 2016 (HOTMA) for the Section 811 Project Rental Assistance (Section 811 PRA) program. On the same day, the U.S. Department of Housing and Urban Development (HUD) released Notice H-2025-07 that delays the effective date for the implementation of HOTMA for Section 811 PRA from January 1, 2026, to January 1, 2027.

TDHCA is providing updated technical assistance as follows:
Between January 1 and December 31, 2026, Owners with properties participating in the Section 811 PRA program would elect one of two options for all tenants participating in the program at a development.
— Option 1: The development maintains pre-HOTMA policies and procedures; and, the Department would not provide technical assistance regarding the implementation of HOTMA during rent and monitoring reviews.
— Option 2: The development implements post-HOTMA policies and procedures besides those directly related to missing finalized forms; and, the Department would provide technical assistance, where possible, on the implementation of HOTMA during rent and monitoring reviews.

On and after January 1, 2027, TDHCA would monitor properties participating in the Section 811 PRA program with full compliance with the implementation of HOTMA. If HUD provides additional guidance, including a revised effective date for HOTMA, the property would be required to implement as required per that guidance. TDHCA would provide notification through its listserv at that time.
Please note, all other multifamily programs monitored by TDHCA have been required to implement HOTMA on all certifications effective January 1, 2024, such as the Housing Tax Credit (HTC) Program and HOME Investment Partnerships Program (HOME).
