The Texas Department of Housing and Community Affairs is aware that questions have arisen regarding tenants’ rights to lawfully possess firearms in their leased premises. The law is clear, and TDHCA reminds development owners and their management agents, that tenants in Texas have a right to lawfully possess firearms and ammunition in rented or leased premises, unless otherwise prohibited by state or federal law.

See Tex. Prop. Code Sections 92.026; 94.257. In short, a tenant in a TDHCA-monitored property can neither be evicted nor have his or her lease terminated solely because the tenant lawfully possesses firearms and ammunition.
