TDHCA’s Single Family and Homeless Programs Division reminds interested parties that the Housing Opportunities through Modernization Act (HOTMA) will be effective on January 1, 2025, for the HOME, Emergency Solutions Grants (ESG), Colonia Self-Help Centers (CSHC), and Texas Bootstrap Loan (Bootstrap) programs. HOTMA amends sections 3, 8, and 16 of the United States Housing Act of 1937, resulting in changes to 24 CFR Part 5 regarding income eligibility determinations for HUD assisted housing. HUD has provided extensive guidance on HOTMA. The Office of Public and Indian Housing, which oversees the Section 8 Program, has provided a resources page that may be found at https://www.hud.gov/program_offices/public_indian_housing/hotmaresources.

Please note that although HOTMA is effective January 1, 2025, the provisions at 24 CFR Section 92.203(b) requiring at least two months of source documentation evidencing annual income are still required for the HOME and Bootstrap programs. This does not apply to the ESG or CSHC programs.
Updated forms will be posted on the website and will be announced in a future communication. Staff are developing a training directed specifically to Single Family Administrators, and we recommend that Administrators familiarize themselves with HOTMA via other available training and resources.
