As part of his approval, Governor Abbott made a targeted modification to the QAP’s force majeure ineligibility provision. Under the version approved by the TDHCA Board, applicants with two force majeure events on the same development would have remained ineligible until that development was fully completed. The Governor narrowed that restriction, allowing applicants to regain eligibility once construction has commenced on the affected development, rather than waiting until completion.
This change meaningfully reduces timing risk for applicants, better aligns the rule with real-world development timelines, and preserves the intent of the provision while avoiding unnecessary barriers to participation.
Looking Ahead
With the 2026 QAP finalized, TAAHP now shifts from rulemaking to implementation and forward planning. Adoption marks a transition—not an endpoint.
On December 16, TAAHP will host a member webinar focused on Significant Changes to the 2026 QAP. In early 2026, TAAHP will also publish a comprehensive report documenting our QAP advocacy, outlining key policy shifts, and previewing priorities as planning begins for the 2027 QAP cycle. Member engagement will continue to guide this work through committees, data analysis, and early issue identification.
