The Texas Department of Housing and Community Affairs (TDHCA) released 10 TAC Chapter 11, the Housing Tax Credit Program Qualified Allocation Plan for public comment, as approved by the TDHCA Governing Board on September 1, 2022. The proposed 2023 QAP will be posted to the Department’s website and published in the Texas Register. Public comment will be accepted between September 16, 2022, and October 7, 2022. Staff will then consider and prepare reasoned responses to public comment as part of the final action on the QAP that will be brought before the Board on November 10, 2022, for approval. Subsequently, the QAP will be submitted to the Office of the Governor not later than November 15, 2022, for him to approve, approve with changes, or reject. Upon the Governor’s approval, approval with modifications, or rejection, which must occur no later than December 1, 2022, the adopted 2023 QAP will be published in the Texas Register and posted to the Department’s website.

The draft QAP identifies the differences between the 2022 QAP and the proposed 2023 QAP in blackline format. The QAP submitted to the Texas Register will be a proposed new version of the 2023 QAP, and will not identify the changes between 2022 and 2023. The Department’s Public Comment page will also include a blackline version of the proposed 2023 QAP as approved by the Board to facilitate stakeholders’ engagement with the changes.

TAAHP Engagement

TAAHP convened a membership meeting to discuss comments and recommendations to the Preliminary Draft 2023 Qualified Allocation Plan (QAP) and Multifamily Rules. TAAHP’s QAP Committee is currently gathering comments to consider for inclusion in the formal TAAHP comment letter to the TDHCA. You can send your comments for consideration to QAPCommittee@taahp.org. You can also copy the members of the committee on any comments sent directly to TDHCA.

Additionally, The Texas Department of Housing and Community Affairs (TDHCA) has updated the Preliminary Draft 2023 selected Site Demographics report. The report contains selected QAP items for which data are currently available. Certain urban/rural data are updated, and rent burden is published as a separate tab. This report is based on the current version of the 2023 proposed QAP and is subject to change.
