The Texas Department of Housing and Community Affairs (TDHCA) is releasing 10 TAC Chapter 11, the Housing Tax Credit Program Qualified Allocation Plan for public comment, as approved by the TDHCA Governing Board on September 2, 2021.
It should be noted that the document posted for comment is not the version posted in the Board’s materials, but includes revisions approved by the Board, as well as other administrative corrections to ensure the document satisfies the requirements of the Texas Register (formatting, numbering, etc.).
In response to the current difficult market conditions, the draft 2022 QAP includes language that allows 2019 and 2020 LIHTC developments to apply for supplemental HTC. TDHCA is allotting $5 million to these requests and will limit requests to 15% of the original allocation amount. Further, to discourage excess requests for supplemental allocations, every $1 in supplemental credits an application received, the developer cap in 2022 will be reduced by $1.50.
The draft QAP can be found on the TDHCA Public Comment Center at http://www.tdhca.state.tx.us/public-comment.htm, and is expected to be posted in the Texas Register edition dated September 17, 2021, at http://www.sos.state.tx.us/texreg/index.shtml. The public comment period begins on September 17, 2021, and ends on October 8, 2021, at 5 p.m., Austin local time.
