On February 19, 2021, President Biden declared that a major disaster exists in the State of Texas and ordered federal assistance to supplement state and local efforts in the areas affected by severe winter storms that began on February 11, 2021.
Revenue Procedure 2014-49 provides relief to Housing Tax credit (HTC) properties impacted by presidentially declared disasters from carryover through the compliance period. The Revenue procedure is on TDHCA’s website at http://www.tdhca.state.tx.us/pmcomp/casualty-loss/declared-disaster.htm.
If your property is in service and has been damaged by this disaster, please inform TDHCA within 30 days through the use of the “Notice of Property Damage from Texas Severe Winter Storms (DR-4586)” form, which is available at http://www.tdhca.state.tx.us/pmcomp/casualty-loss/disaster-loss.htm. The form should be uploaded to your CMTS account to the attention of Cherie Shearfield.
If you are an HTC property and willing to provide emergency housing for displaced individuals, please complete the “Request to Provide Emergency Housing” form at https://www.tdhca.state.tx.us/pmcomp/casualty-loss/emergency-housing.htm, and upload it to your CMTS account. Displaced individuals must be displaced from their principal residence as a result of the disaster, and their principal residence must have been located in a major disaster area designated as eligible for Individual Assistance by FEMA. We urge all owners to update their Unit Status Report to ensure accurate and reliable information about housing inventory. In addition, please review Revenue Procedure 2014-49 carefully to avoid noncompliance.
