The Austin Animal Advisory Commission has formally recommended that the Austin City Council require pet-friendly policies in all housing developments that receive City funding, subsidies, tax incentives, or other forms of public financial assistance.

Recommended policy components:

  • Pet-Friendly Requirement: Housing developments receiving City funding, tax credits, or other public financial support should permit residents to keep companion animals.
  • Prohibition of Breed and Weight Restrictions: Providers should not impose blanket breed-specific or weight-based restrictions on companion animals.
  • Waiver and Subsidy for Pet Deposits or Fees: If deposits or fees are required, the Commission references a proposed Texas bill allowing a maximum of a $500 refundable deposit OR $20/month pet rent (not both). The recommendation suggests the City consider subsidizing pet bonds for dogs over 40 pounds if larger deposits are required.
  • Individual Behavior-Based Evaluation: Any restrictions should be based on documented behavior of an individual animal (e.g., bite cases or complaints on record) rather than breed, size, or appearance.

The recommendation also notes examples of recent state-level actions addressing pet-inclusive housing policy: Nevada, Colorado, and California have enacted or proposed measures limiting blanket pet prohibitions and requiring pet accommodations in certain publicly supported housing contexts.

The Commission’s recommendation was submitted for City Council consideration as a policy measure aimed at reducing housing-related pet relinquishment and informing housing policy for developments receiving public assistance.
